Terms of Service

These terms explain what you can expect from Acerstone and what we expect from you when you use our website and platform.

Agreeing to these terms

These Terms of Service are an agreement between you and Acerstone ("Acerstone", "we", "us"). By creating an account or using the platform you accept them, together with our Privacy Policy. If you are using Acerstone on behalf of a company, you confirm that you have authority to accept these terms for it. If you do not agree, do not use Acerstone.

What Acerstone is

Acerstone is a platform where vetted experts build a profile and a knowledge base, get matched to client projects, and take part in expert communities. We provide the platform, vetting and matching.

We are not a party to the work an expert does for a client, and we are not the employer, agent or partner of any expert. Experts decide independently whether to take on a project and how to carry it out.

Your account

  • You must be at least 18 and able to enter into a binding agreement.
  • You can sign in with LinkedIn or Google, or register with an email address. Keep your sign-in details secure; you are responsible for all activity on your account.
  • Give us accurate information and keep it up to date.
  • One person, one account. Do not share your account, or create one for someone else without their permission.

Your profile and vetting

Your profile and knowledge base must describe your own skills, experience and work truthfully. We vet experts using the information you provide, including automated review by AI models followed by our own decision.

Vetting is our own assessment and not a guarantee of an expert's work. We may decline an application, ask for more information, or withdraw vetted status if we find a profile is inaccurate or these terms have been broken.

Your knowledge base and AI features

Acerstone uses AI to help you build your knowledge base from your own input, your voice interview and your calls, and to answer questions in your place through your digital twin if you switch it on.

  • Nothing the AI draws out is published until you review and approve it. You are responsible for checking that what you approve is accurate and that you are free to share it.
  • Your digital twin answers only from items you have approved and enabled for it. Its answers are generated automatically, can be incomplete or wrong, and are not advice from you or from Acerstone unless you confirm them.
  • Do not add confidential information belonging to a client or employer unless you have the right to share it. Mark anything you cannot discuss as confidential so it is kept out of what is published and out of your twin.
  • If you rely on any AI-generated content on Acerstone, you do so at your own judgement.

Calls and recordings

Calls booked through Acerstone take place on Cal.com's video service and may be recorded and transcribed, as described in our Privacy Policy. By joining a call you agree to this, and you agree not to record a call by other means without the consent of everyone on it.

Please cancel or reschedule a booked call in good time if you cannot attend.

Matching and projects

We match experts to projects based on profile and knowledge-base information. We do not promise that you will be matched, or any amount of work or income.

When you accept a project, you agree to deliver the work as described, to the standard a client can reasonably expect, and within the agreed timeline.

Experts act as independent professionals. You are responsible for your own taxes, insurance, licences and compliance with the laws and professional rules that apply to your work.

Fees and payments

The fee, milestones and any platform charges for a project are shown to you before you accept it. Payments are released as milestones are approved.

Do not arrange or accept payment outside Acerstone for a project, or a follow-on engagement with a client, that you were introduced to through Acerstone.

Confidentiality

You may receive non-public information through Acerstone, such as client briefs, project details and other members' messages. Use it only for the purpose it was shared for, do not disclose it to anyone else, and protect it with reasonable care. This continues after a project ends or your account closes.

Messages and communities

Direct messages and communities are for professional conversation related to the platform. Community hosts and Acerstone may remove posts or conversations that break these terms, and you can block other members or report content to us.

Content you post in a community can be seen by its other members, and messages you send stay visible to the people you sent them to.

Your content

You keep ownership of what you add to Acerstone, including your profile, knowledge base, portfolio, case studies and community posts. You give us a non-exclusive, worldwide, royalty-free licence to host, store, process, display and share that content, including through your digital twin, in order to operate, improve and promote the platform. This licence ends when you delete the content or close your account, except for copies we must keep by law or that others have already received.

You confirm that you have the rights needed to share the content you add, including any client work shown in your portfolio or case studies.

Acceptable use

You agree not to:

  • Misrepresent who you are, your qualifications or your past work.
  • Post content that is unlawful, defamatory, harassing, discriminatory or that infringes someone else's rights.
  • Send spam or unsolicited promotions, or contact members for purposes unrelated to the platform.
  • Copy, scrape or harvest data from Acerstone by automated means, or use it to build a competing service.
  • Try to make a digital twin, or any other AI feature, reveal information it is not meant to share.
  • Interfere with the platform, access it without authorisation, or get around its security or rate limits.
  • Use the platform to break any law.

Our platform

Acerstone, including its software, design, name and logo, belongs to us and is protected by intellectual property laws. We give you a limited, revocable, non-exclusive, non-transferable right to use the platform as these terms allow.

Some features rely on third-party services such as LinkedIn, Google and Cal.com. Your use of those services is subject to their own terms, and we are not responsible for them.

If you send us feedback or suggestions, we may use them without any obligation to you.

Suspension and closing your account

You can stop using Acerstone and ask us to close your account at any time. We may suspend or close an account that breaks these terms, puts other members or the platform at risk, or where the law requires us to. Where it is reasonable to do so, we will tell you why.

Obligations for projects already under way, payments owed, confidentiality and the sections of these terms that by their nature should continue, continue after an account is closed.

Disclaimers

Acerstone is provided "as is" and "as available". To the extent the law allows, we make no warranties about the platform, about any expert, client or project, about AI-generated content, or about the results you will get. We do not guarantee that the platform will be uninterrupted, secure or free of errors.

Limits on our liability

To the extent the law allows, Acerstone is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, goodwill or data, arising from your use of the platform. Our total liability to you for all claims is limited to the fees Acerstone received in connection with your account in the twelve months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law.

Indemnity

To the extent the law allows, you agree to cover Acerstone's reasonable losses and costs arising from a claim by a third party that results from your breach of these terms, your content, or the work you do for a client.

Changes to these terms

We may update these terms as Acerstone changes. If a change is significant we will tell you by email or in the product before it takes effect. Continuing to use Acerstone after a change takes effect means you accept the updated terms.

General

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a right straight away, we have not given it up. You may not transfer these terms without our consent; we may transfer them to a successor of our business. These terms, together with the Privacy Policy, are the whole agreement between you and Acerstone about the platform.
